Warranty conditions
Contractual product warranty:
In the European Union, gilles tooling products are covered by the legal guarantee for consumer goods granted to consumers by Directive 1999/44/EC of the European Parliament and of the Council of 25 May 1999 on certain aspects of the sale of consumer goods and associated guarantees, and its transposition into national law. This guarantee begins with the delivery of the goods to the end user.
In addition, gilles tooling grants a contractual warranty on all products within the scope of and in compliance with the following warranty provisions. The statutory warranty claims are in no way limited by this contractual guarantee.
The contractual product guarantee only applies to products purchased in EU member states.
Please note!
Gilles tooling products used for competitions or sporting events are excluded from these provisions.
Subject of the guarantee
Gilles tooling guarantees the original purchaser that if material or manufacturing defects are found in the new product, the defect will be rectified free of charge within the agreed warranty period, without mileage limitation.
If the purchaser is a consumer, he shall initially have the choice of whether subsequent fulfilment is to take the form of repair or replacement. However, Gilles tooling shall be entitled to refuse the type of subsequent fulfilment chosen if it is only possible at disproportionate cost and the other type of subsequent fulfilment is without significant disadvantages for the consumer.
Agreed guarantee period
The warranty period is 2 years for all gilles tooling products.
The warranty period shall commence upon delivery.
The warranty period shall not be extended, restarted or otherwise affected by subsequent resale, by repair measures carried out by gilles tooling or by replacement of the product.
If the product is resold within the warranty period, the following provisions shall remain in force to the same extent and can also be asserted after a change of ownership. The original proof of purchase must be available in the original or as a copy.
Warranty claims must be reported to your authorised dealer or to gilles tooling directly immediately after discovery of the alleged defect and always before expiry of the warranty period.
Warranty conditions
Warranty is provided if the following conditions are met:
- All components must be in standard condition and must not have been subsequently modified.
- Proof of purchase must be available.
- All components must be used on standard vehicles.
If there is any doubt about the existence of a defect, or if a visual or material inspection is necessary, gilles tooling is authorised to request and inspect the defective parts.
Parts replaced as a result of a warranty claim shall become the property of gilles tooling after the claim has been recognised.
For components that are repaired or replaced within the warranty period, the warranty ends when the agreed product warranty expires.
What is not covered by the contractual warranty?
Gilles tooling does not provide replacements:
- After improper handling, non-compliance with the assembly and operating instructions, and overuse.
- When used on special conversions and the use of special accessories.
- After participation in motorsport events or competitions.
- In the event of damage that was not reported immediately after it was discovered or should reasonably have been discovered.
- In the event of coating or corrosion damage caused by external influences such as stone chipping, road salt, industrial fumes and other environmental influences or improper cleaning using unsuitable care products.
- In the case of normal wear and tear and normal signs of use that occur on various components as a result of normal use and do not impair the usability of the product.
- For natural or premature wear of bearings and sprockets.
- For consequential damage as well as direct and indirect costs such as
Loss of use, loss of earnings, recovery, towing and/or accommodation costs.
- For other events beyond the reasonable control of gilles tooling.
To the extent permitted by law, Gilles Tooling's liability is limited to the purchase value of the product.
How do you claim the warranty?
To make a claim under the warranty, please contact Gilles Tooling G.m.b.H., Société à responsabilité limitée, with registered office in L-6776 Grevenmacher, 26, Op der Ahlkerrech, Z.I. Potaschbierg, or your authorised dealer. When returning the product, please enclose the proof of purchase showing the dealer, date and place of purchase of the product. You are responsible for the costs of returning the product.
If you return a product that is not under warranty, Gilles Tooling will return the product to you unrepaired or, after consultation, will repair it against payment on the basis of a prior quotation.
Other important notes
The warranty promise applies as an additional agreement to the existing warranty right. Under the applicable legislation on the sale of consumer goods (Act of 21 April 2004 on the warranty of goods and related provisions of the Civil Code), the consumer has legal rights that are not affected by the warranty. The statutory warranty period for the purchase of consumer goods is two years. Further contractual claims according to the terms and conditions of the seller, such as the reduction of the purchase price (reduction) or the cancellation of the purchase contract (conversion) remain unaffected by this and can only be asserted against the seller in accordance with the legal requirements.
There is no entitlement to a replacement delivery by gilles tooling.
At the consumer's request, the warranty shall be made available to him in writing in German or French or English (together with a German or French translation) or shall be contained on another durable medium which is available and accessible to the consumer.
The law of the Grand Duchy of Luxembourg shall apply exclusively to contracts concluded by gilles tooling on the basis of these guarantee provisions and to claims of any kind arising therefrom, to the exclusion of the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG).

Cancellation of orders
Withdrawal from the contract on our part is possible if we become aware of a suspension of payments, the opening of bankruptcy or judicial composition proceedings, the rejection of bankruptcy for lack of assets, bill or cheque protests or other concrete indications of deterioration in the customer's financial circumstances.
